Welcome to Capture Biz! These Terms of Service (“Terms”) govern your access to and use of our website, products, and services. By using our website or engaging our services, you agree to these Terms. If you do not agree, please do not use our services.

Services Provided

Capture Biz offers AI-powered marketing and lead management services, including but not limited to: AI Database Reactivation (DBR), AI SMS Lead Follow-Up, AI Voice Receptionist Services, Google Review Bot, and CRM Integration and Automation. Additional premium services may be offered under separate agreements.

Client Responsibilities

By using our services, you agree to provide accurate, complete, and lawful data, including lead lists that comply with all applicable privacy and consent regulations (e.g., TCPA, CAN-SPAM, GDPR, CCPA), use our services only for lawful business purposes, and maintain the confidentiality of any login credentials or API access provided. Capture Biz is not responsible for fines, penalties, or legal issues resulting from the use of non-compliant lead data.

Payments & Subscription Terms

The one-time setup fee is due prior to service activation. Payment must be submitted to begin onboarding and to secure access to any limited-time promotional pricing.

Monthly subscription fees are automatically billed every 30 days from the date of initial service activation, using the payment method provided at checkout. Clients are responsible for maintaining a valid payment method on file to avoid service interruption.

Cancellation & Termination

You may cancel monthly services with 30 days’ written notice before your next billing cycle. Capture Biz may terminate services at any time for non-payment, violation of these Terms, or unlawful use of services.

Intellectual Property

All content, AI bots, and service processes developed by Capture Biz remain the exclusive intellectual property of Capture Biz. You may not replicate, reverse-engineer, or redistribute any of our intellectual property without written consent.

Limitation of Liability

Capture Biz is not liable for direct, indirect, incidental, or consequential damages resulting from the use or inability to use our services. Maximum liability under any circumstances is limited to the total amount paid by the client in the previous 3 months.

Dispute Resolution

All disputes shall be governed by the laws of the State of Iowa. Disputes will be resolved through binding arbitration in Des Moines, Iowa. You agree to waive any rights to class action claims.

Modifications to These Terms

We may modify these Terms at any time. Continued use of our services after changes implies your acceptance of the new Terms.

SMS Messaging Terms

Capture Biz Alerts is our SMS program used for account updates, demo reminders, and promotional offers. You can cancel the SMS service at any time by replying “STOP” to the shortcode. We will confirm your unsubscribe status and you will no longer receive SMS messages. To rejoin, opt in as you originally did and we’ll resume messaging. If you experience issues, reply “HELP” or contact [email protected] or 515-461-8642. Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages. By participating in our SMS program, you also agree to our full Privacy Policy.
